Timepieces Australia does not represent or warrant that the functions contained in the site will be uninterrupted or error-free, that the defects will be corrected, or that this site or the server that makes the site available are free of viruses or other harmful components. Typographical Errors
In the event that a Timepieces Australia product is mistakenly listed at an incorrect price, Timepieces Australia reserves the right to refuse or cancel any orders placed for product listed at the incorrect price, whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is cancelled, Timepieces Australia shall issue a credit to your credit card account in the amount of the incorrect price.
Termination
These terms and conditions are applicable to you upon your accessing the site and/or completing the registration or shopping process. These terms and conditions, or any part of them, may be terminated by Timepieces Australia without notice at any time, for any reason. The provisions relating to Copyrights, Trademark, Disclaimer, Limitation of Liability, Indemnification and Miscellaneous, shall survive any termination.

Your use of this site shall be governed in all respects by the laws of the NSW. You agree that jurisdiction over and venue in any legal proceeding directly or indirectly arising out of or relating to this site (including but not limited to the purchase of Timepieces Australia products) shall be in the state of NSW. Any cause of action or claim you may have with respect to the site (including but not limited to the purchase of Timepieces Australia products) must be commenced within one (1) year after the claim or cause of action arises. You acknowledge that by providing you with the ability to view and distribute user-generated content on the site, Timepieces Australia is merely acting as a passive conduit for such distribution and is not undertaking any obligation or liability relating to any contents or activities on the site. However, Timepieces Australia reserves the right to block or remove communications or materials that it determines to be (a) abusive, defamatory, or obscene, (b) fraudulent, deceptive, or misleading, (c) in violation of a copyright, trademark or; other intellectual property right of another or (d) offensive or otherwise unacceptable to Timepieces Australia in its sole discretion.
Indemnification
You agree to indemnify, defend, and hold harmless Timepieces Australia, its officers, directors, employees, agents, licensors and suppliers (collectively the "Service Providers") from and against all losses, expenses, damages and costs, including reasonable attorneys' fees, resulting from any violation of these terms and conditions or any activity related to your account (including negligent or wrongful conduct) by you or any other person accessing the site using your Internet account.

In an attempt to provide increased value to our visitors, Timepieces Australia may link to sites operated by third parties. However, even if the third party is affiliated with Timepieces Australia, Timepieces Australia has no control over these linked sites, all of which have separate privacy and data collection practices, independent of Timepieces Australia. These linked sites are only for your convenience and therefore you access them at your own risk. Nonetheless, Timepieces Australia seeks to protect the integrity of its web site and the links placed upon it and therefore requests any feedback on not only its own site, but for sites it links to as well (including if a specific link does not work).
Accepting Goods and participating in Services delivered by Timepieces
1. Interpretation of terms
"Agreement" means an agreement between the Customer and Timepieces Australia to supply Good(s), which consists of the Order and these Conditions.
"Conditions" means the Terms and Conditions outlined in this document.
"Customer" means the person or legal entity depicted in Timepieces Australia Cart, Receipt or Invoice
"Damaged Good(s)" means defects that impairs the value of the Good(s).
"Delivery Address" means the address the Good(s) are to be delivered to as stated on the Receipt or Invoice.
"Good(s)" means the Good(s) described in an Order to Timepieces Australia.
"Order" means an Order by the Customer to purchase Good(s) from Timepieces Australia. The Order may be provided by our online Shopping Cart, by mail or by fax.
2. The Agreement
a. An Agreement exists between the Customer and Timepieces Australia for the purchase of the Good(s) by the Customer from Timepieces Australia once Timepieces Australia accepts an Order by way of order confirmation.
b. Each order is its own agreement.
c. The Customer acknowledges and agrees to be bound to the Conditions outlined in this document.
3. The Order
a. The Customer will begin placing an Order with Timepieces Australia by either:

e. Orders once placed with Timepieces Australia are non- cancellable and non- refundable. For complete details refer to Section 7 "Refund Policy".
f. If the Customer does not advise Timepieces Australia that they do not wish to proceed with their order due to leadtimes confirmed on Timepieces Australia order confirmation within 5 days, then the order will be taken as having been accepted.
4. Pricing
a. All prices listed on the website are in Australian Dollars ($AUD) and all Recommended Retail Prices where shown are inclusive of all taxes. Timepieces

5. Payments
a. The Customer shall pay for all shipping and handling charges.
b. Payment must be made in full to Timepieces Australia and all funds must be received prior to the delivery of the Good(s).
c. Payment can be made using the following methods:
- Electronic Funds Transfer (EFT)
- Selected Credit Cards (Including MasterCard, Visa)
- Bank cheques and money orders
Note: No merchant fees apply for payments by MasterCard or Visa credit cards.
6. Delivery, Receiving and Inspection/Unpacking Good(s)
a. The correct delivery, correct receipt process and inspection/unpacking of our good(s) are very important steps to us to ensure your total satisfaction. Our packaging is designed to protect our good(s) every step of the way from the factory to your home. It is important that the instructions are strictly followed when receiving and inspecting the good(s).
b. The Good(s) will be delivered to the specified address on the Order.
c. Timepieces Australia require that the contents of the Goods, when delivered, are inspected within a reasonable time from that delivery which is deemed to be no longer than 3 days from the date of receipt.
If you suspect any short delivery of components or any other concerns please contact us by phone, fax or email. Early advice will enable prompt rectification if required. If we are not advised of short delivery within the agreed period then delivery will be deemed to have been completed. We may require photographs to be sent to us to allow assessment of any problem.
d. If you are dissatisfied about any aspect of our service or good(s), we require a note in writing via fax, email or mail outlining the issue direct to Timepieces Australia on the contact details provided. We undertake to contact the customer and discuss the issue within 7 days and to rectify any issue deemed to be our responsibility as soon as possible. We undertake to keep the customer informed on a regular basis as to the progress of the resolution.
7. Refund Policy
a. The goods ordered will be allocated to the customer and our regular sales process will proceed to ensure the goods are delivered to the customer in good order. Order(s) are non-cancellable and non- refundable following a period of 48 hours of receipt of the order by Timepieces Australia. Notice of cancellation will only be accepted in writing by mail, fax or email within 48 hours. For the purposes of clarity, Timepieces Australia will acknowledge cancellations in writing and confirm refund details. No refund will be given for "Change of Mind" subject to the extent permitted by law.
b. Following receipt of the order our customer service team will contact the customer and provide an estimate of delivery date. If the Customer does not advise Timepieces Australia in writing within 48 hours that they do not wish to proceed with the order due to the projected delivery dates advised on the Order Confirmation, then the order will be taken as having been accepted. If the order is then cancelled after the 48 hours, any payment paid will be forfeited in full.
8. Title to the Good(s)
Title in the Good(s) shall pass from Timepieces Australia to the Customer when payment in full has been received by Timepieces Australia and full acceptance of the delivery of the Good(s) by customer at the Delivery Address.
